I would think you will do OK since it is so obvious who was at fault..and they totaled your truck. Maybe you will be feeling more pain in the next few days. Very sorry this happened. As somebody said it looks like the truck could be fixed. Hope you keep us posted on what happens. Will you get a rental vehicle at the cost of the others insurance? That should be the 1st thing to happen.

in california if you rear end someone with lights that are smoked like that its a pretty easy defense that you couldn't tell they were braking and that theyre at fault since the law doesn't allow them

Still.....had there been normal taillights where you can actually see brake lights shining through the lenses, the chances of this happening would be reduced. Brake lights on heavily shaded tails like the OP light up darker than running lights......the unsafeness is even more great in daytime/dusk/dawn. Sure the guy who plowed into him probably wasn't paying attention, but as I said above, had those lights been visible, chances of this accident happening would've been reduced.

PS: I'm a hardcore niteshade hater. It's the gayest, grossest, and unsafest fad ever.

I'll agree with you that the chances may have been reduced had the tail lights not been smoked out. Buddy that hit him still needs to be paying attention to the road in front of him and should therefore be charged with careless driving if what has been told is true. There is no excuse to rear end anyone in broad daylight on dry pavement.
