He wont win. Rick appears to be fixated on trying to establish power through threats and intimidation. His decision to threaten us with a DMCA, then file a DMCA after I LOLed at his threat, is consistent with his character.

You see, after he filed the DMCA the easiest and quickest way for FRF to comply would have been to simply remove the content. It's very likely he never expected to win the case, but instead was hoping I would be intimidated into taking the quick and easy way out. The amount of time involved with fighting a DMCA far exceeds the time required to comply with the accusers wishes. It's really not much different than when individuals sue corporations for a few thousand dollars hoping the corporation would just give in instead of wasting even more resources fighting it. I literally could have ended the whole situation in less than a minute had I given in, but I'm not that kind of guy, I have no problem spending extra time doing the right thing.... especially when doing it pisses off people like Rick.

To answer your question though if he did somehow win (he wont) our host and internet provider would be obligated to suspend our services until the content was removed, and it would open the way for him to sue us for punitive damages. A DMCA usually precedes being sued as a DMCA is to "fix" the problem and suing is to be recouped for the problem.

The fact that he would knowingly commit perjury (a crime) in an attempt to intimidate us says a lot about his character IMHO.

There is a method behind Rick's madness. It is all money for him. Anyone who speaks negitively of his site could cost him income. Anyone who questions him could cost him income. Anyone who talks about his site in a chat room or on another forum could cost him income. And now anyone who has content on a site other than could cost him income. He will stop at nothing to prevent his loss of income. He will lie and cheat to whoever necessary whenever necessary. Its like a bad movie playing out right here in front of us.

And just to clear up the whole t-shirt "copying", that RF design was around for quite a long time before FRF was even considering shirts. Early summer '09 if I recall correctly.
