Apparently Rick is thumping his chest regarding his last legal claim, stating that our host required us to remove content (implying we did something wrong). I thought I would add some clarification.

The way the law is written is that upon receiving a copy of the legal complaint the service provider (our webhost) is required to ensure the content in question is removed. Failure to do so would result in them being liable for damages. The idea being that if the content exists while waiting a judgment the damages would continue to grow.

So, yes, after R/F’s first legal claim, our host abiding the law, and as the law requires, requested we temporarily remove the content. The temporary removal of content has nothing to do with who is wrong, or who is right, it is simply a process required. After a couple weeks his claim was trashed and we restored the content.

That is the only content our host ever asked us to remove, and following the legal procedure, after R/Fs claim failed our host fully supported us restoring accessing to that same content. So in essence, it is as if nothing ever happened.

lmao and you don't have anything saved....if you don't clear your cookies on the browser, when you access the site you won't have to log in. if you do clear them thats when you have to log in. You're not always logged in either. Only when you access the site from that computer it will log you in automatically but when you're not on the site it shows you're offline after a certain amount of inactivity

Hey fellers!! know its been awhile...lol. has anyone thought about a counter suit since whoever has proof that this site was what it was before hand? I dont really care for certian people either but it is what it is and i usually just let it roll since it doesn't directly affect me. I will NEVER contribute to RF again after the way i and ALL the other contributors were done. But thats just my lil peice of it.....anyways got a nice big bowl of ice creme sittin here so i gotta get!!

BTW: since some you of you MAY not know..i sold the short bus and bought a lil 95 4 banger!

While a counter suit is not a bad idea, it is also sinking to the same level as the other Forum operator. I think doing that would just make the whole situation worse.

Update:

Due to Rick's reputation of frivolous claims his paperwork is being scrutinized to ensure it is properly filled out. Rick has submitted four incomplete legal claims which I'm told are sent back and I'm told he resubmits them only slightly altered each time.

It's been a week since his last claim was returned for failure to fill out the paperwork correctly, so for now this case is closed.

My thought process is similar to Jimmehs. Rick is continuously trying to disrupt our operations, complaining to our host, etc. and he continuously fails so he doesn't really affect FRF operations beyond just being an annoyance. Yes, I could attempt a lawsuit against Rick for frivolous claims, and yes I've thought about it. But I ask you, how would that benefit the forum or our members? Simple answer, it wont.

Seriously though, a countersuit with monetary compensation would be the responsible thing to do, even if not done for money, at least to deter anyone else from acting maliciously against this site in the future.

Well thats entirely up to you or whoever it concerns....if you want this guy outta your hair there are legal ways of doing that..( i know people)
:-) but is it worth it to the people thats its affecting? there could be MANY benifits but ,may not be worth the bother for it. Anyways thats just my two cents...sounds like you got a pretty good handle on it though, and yes sometimes its just better to let the other just shoot themselves in the foot!! LOL!!! LOVE THE SITE MAN!!! I NEED TO START HANGIN HERE MORE ANYWAYS!!!!
