Default Help with selling car overseas

I've sold cars/ boats privately and know the process for payment and transferring titles but this is new to me, hopefully someone has some input. I recently lined up a potential buyer for my father's car who lives in Spain. I've been emailing/ talking to him on the phone for about a month now and he is very interested. He hired a third party pre-purchase inspector who already came buy, inspected the car, and now will be the liaison between me and the buyer and will take care of shipping the vehicle.

The buyer, himself, will be wiring 75% of the sale price to my father. Third party pre purchase inspector will come pick up the car after everything clears and will pay the rest of the 25%, pick up the car, and the title will then be signed over. This is where I'm confused, I will never meet the buyer face to face so how does he sign the title to be transferred to him? Does the third party take care of this? Also once the title is transferred how does my father no longer become liable for the car as it will take a while for the title to be transferred to the buyer and car registered in Spain? Don't want my father to liable if the car gets damaged during shipping or is used in some kind of crime once it leaves his driveway.

I would think you could set up an agreement between you and the buyer and have the signatures notarized. I'm a notary and I have done titles before. But to protect you and your father you might want to look into a contract.

Something doesn't seem right, and I don't know why a 3rd party has to get involved. Also, I don't know the laws of Spain. Here, I think once the title is signed over then the selling party should be excluded from liability, but the problem is that you aren't meeting the actual buyer. I think that a lawyer or someone familiar with contracts should be contacted because signing a contract not drawn up legally can be disputed later.

payment will be wired to a "dumby" account and once cleared will then be transferred to my father's account. I'm not really worried about the scam factor just don't know how to transfer the title without buyer's signature.

This will be done along with a bill of sale but I still don't know how I will get the buyer's signature.

As nice as a contract is, just know that you can't really enforce it with the buyer. The buyer lives in Spain, you live in the US. If the guy rips you off, are you really going to fly to Spain and spend weeks there trying to recoup your money? In a place where you probably have no idea of what their laws or court systems are like? Probably not.

Plus, an international contract requires a lawyer who is familiar with the laws of the US, Spain, and international laws. Thus, it wont be a cheap service.

If anything, a basic contract with the liaison would be what I would pursue. Might even consider an escrow service.

Receiving wire transfers is the safest way of receiving money so definitely a positive sign they want to send it that way. I would still wait a few days after payment to make sure it's completely cleared your bank.

Got it situated. Third party will represent buyer. Father will fill out a "notice of sale" which relinquishes his ownership immediately once put into the system.
