Marriage Question
I was talking to a guy that was thinking about Divorcing his wife and he said even though he bought and paid for certain items before his marriage his wife is still entitled to half. Is there anyway around this? I mean if you ask the chick for a pre nup isnt that kind of saying like it wont work? Is there like another loop hole so she dosent run off with your stuff.

Idk. Just a new guy I work with saying he wanted a divorce. I always thought the stuff you have before marriage that you paid for and thats in your name is the stuff you would get to keep. Obviously I was wrong.

Re: Marriage Question
Usually, without a prenup, everything b4 and during is community property.
The lesser earner can ask for support, insurance, tuition...
Are there unusual circumstances? pets, kids, special items...
I had a mutual settlement, she moved out, I kept the house, paid her half the equity, she had to sell "her" truck and pay me 1/2 the value...

Re: Marriage Question
If it was used in the course of the marriage basically it belongs to both parties. One of the guys at work here had a family cabin passed down a couple generations to him, he got divorced, and because it was used in the course of the marriage as a vacation property she was entitled to half and he had to pay her out. I completely disagree with that concept.
Prenup is the way to go, especially if one person has more assets than the other at the beginning of the relationship. I know I will be asking for one to protect my ass when I eventually get hitched.
Courts can overrule prenups as well. I've heard of cases where the wife signs away any support, quits her job to stay home and raise the kids, divorce happens and the courts rule that she is entitled to child support and some alimony.

Re: Marriage Question
It also depends on where you live...some all states have their own laws about it...I know in Arizona as a guy if you get married and divorced you might as well off yourself cause you will get nothing and have to pay more then you make to your ex...yeah my friend got screwed in his divorce and had to take a second and third job for about 3 years to stay up on the bills...

Re: Marriage Question
Definitely one of those things where you want to consult an attorney first. There may be some sort of loopholes he can take advantage of, such as transferring assets out of his name prior to filing for a divorce.
