Default Ticket

So i got pulled over and ticketed today for talking on my phone. I know it was wrong. but the cop told me that if i had my phone on speaker instead of holding it against my head i would have not got a ticket. To me i feel way for distracted using the speaker on my phone. I feel it way more comfortable to had the phone againts my ear. I'm not really complaining but using the speaker on my phone and holding it seems way harder to do while driving. I dont know what are your thoughts on this?

He's not suggesting you hold the phone and use the speaker. He's suggesting you put it down. The point is to not have the phone in your hand. Most cell phones, the speakerphone mode blows. I suggest a wired headset, or a bluetooth headset, or bluetooth it to the truck's stereo, which is what I do, and it kicks ass.

A bluetooth ear piece is what I use. Especially when I'm using the GPS feature. It's too hard to hear the directions with the speaker on the phone. Bluetooth ear pieces aren't too expensive either and a lot cheaper than a ticket.

I leave my phone at the house. You should invest in a hands free device such as a headset. That will be happening alot more often now, especially if they see you texting while driving. They've been having too many accidents as of late because of the cell phone situation. Law makers in various states have issued alot of new laws concerning this matter and I'm told the fines are going to be extremely high too. Pretty soon from what I gather, they might be able to suspend driver's licenses before long for repeat offenders who can't put the cell phone down.

Um...actually he is saying you can have the phone in front of you in your hand. It's part of the stupid law that you can have it on speaker and hold the phone in front of you. I have to remember that every time I go home to WA. I do own a bluetooth, it sucks more then the speaker phone mode on my phone! I didn't buy the cheap one either

You sure? Seems a little strange. I know in California it specifies hands free.

Actually I think it's about 38 states now not just california either. My state has them, but they really don't enforce the talking on the phone laws. They'll pull you over in a split second if they see you texting though. That's the main problem right there IMO, texting while driving. These kids don't know or don't want to know what kind of problems they cause by doing that.

I'll look it up, but according to the 5 million news reports I saw on it when I was home, and the officer that was on several of those shows, it was perfectly legal if you held it in front of your face and talked on it, as long as it was not to your ears.

You might want to do just that my friend, because I think they changed alot of the cell phone rules now that they've noticed the texting while driving and what it has caused. Law makers have been pushed by various law enforcement agencies into a corner and they had to do something to get them off their backs.

Here's what it says:

RCW 46.61.667

Using a wireless communications device while driving.

(1) Except as provided in subsections (2) and (3) of this section, a person operating a moving motor vehicle while holding a wireless communications device to his or her ear is guilty of a traffic infraction.

It specifies to your ear, but later it says...

(4) For purposes of this section, "hands-free mode" means the use of a wireless communications device with a speaker phone, headset, or earpiece

It's not real clear on the whole thing about holding it in front of you, but that is what was told to me on the news back home on several of the local stations.

here's the link to the State RCW: http://apps.leg.wa.gov/rcw/default.aspx?cite=46.61.667

x2

Since my stock head unit doesn't have bluetooth, I have a bluetooth FM transmitter. With the mic on my visor and the speaker coming through the radio, it's pretty much like talking to a passenger.

Now that is wierd there. They might be changing that soon though. There's a bunch of new laws going into effect this september in my state and quite a few others as well.
