well guys, as the title states. i was driving my s10 (thank god it wasnt the ranger) and a lady pulled out in front of me and I hit her going about 40 mph sliding and on the brakes. but i need some advice.

i already know its not my fault and the cops have told me its not my fault. but apparently the person i hit the cops in my city had been looking for, for quite some time. After i hit her we pulled into a parking lot and i got out of my truck (pissed off and about to hit her) when she says "can we please not get the cops involved? im driving on a suspended license and this is a rental". so right as i was about to call the cops, guess who shows up. yup, 3 of Topeka's finest. one of the cops that did show up i know fairly well and my parents know him so i got lucky on that one. then he proceeded to tell me that "we have been looking for her and her boyfriend for about the passed 3 or 4 months and we had no idea where they lived, what she drove, and who was supporting them" SO, after the cop searches her vehicle and what not, he tells me that she has no insurance; her drivers license is revoked, not suspended; the car she is driving is a rental; she isnt authorized to drive it; and they didnt pay the 8 dollar rental insurance when they paid to rent the car. so i guess the advice i am asking for is: what do i do in this situation? my truck had liability on it. do i try and go after her and sue her? do i just let it go? if i try to sue her i think i would just be wasting my time and money on an attorney and court fees because if they cant afford insurance then god knows they cant afford to pay me what i want. lol. i know insurance should give me some money to repair my truck. i ended up having a fucked up neck today so i went to the doctors and they told me is was muscle spasm (nurse there was cool as shit and hot as fuck btw). just not really sure on what to do. here are some pictures of the aftermath









oh ya, before i forget. i guess her and her boyfriend are wanted on some drug, arsen, and some gang shooting charges. i guess i opened up a whole shit storm for them!

I work in law enforcement, so let me try and help.

Tell ALL OF THAT to your insurance, get copies of the accident reports, the Officers names, etc. And tell your insurance all of that. They (your insurance) will probably take HER to court to sue HER, and whoever the car was rented to. This may take a while, but thats how it is.

well i told all the cops all of that and i have been trying to keep in touch with the one cop that i know. i cant really do anything about it until Monday because the wreck happened yesterday (friday) at 3:30 in the afternoon and by the time we got out of there it was 5:00 and everybody had closed. is there anything else important that i should tell the insurance company??? we think that Enterprise rental should compensate us for the damages. but we arent sure.

Make sure your insurance company knows that she had a revoked DL and was NOT supposed to be driving the rental, anyhow. Not sure 100% if Enterprise would reimburse you. However, the person who rented to car is responsible for the damage to THAT car. Even if you had rearended her, the person who rented would be responsible, because he left an unauthorized person rent the car. I guess your insurance company could try to get money from them, but once you file a claim with your insurance, and fill out whatever paperwork they send you, its all in their hands. Thats why you have insurance, they work for you bro...

As far as anything else to tell them, just sit down, an write out a complete statement, like you just did here (word for word what she said, what you said, what the cops said, etc.) And tell that to your insurance company. The more information the better. Sounds like SHE was at fault to me too...good luck man. Glad that you weren't hurt, and that it wasn't the Ranger!

ok. i will be sure to tell them everything. and yes, it was indeed her fault. i was in the left lane heading north and somebody in the right lane waved her to pull out and she wanted to go south on the street. well she just stopped in my lane and i nailed my brakes as hard as i could and hit her. then she drove off and i thought she was pulling a hit and run but she ended up going into a parking lot. and i doubt her car would of made it very far anyway. lol!

ALSO: my friend just happened to be walking inside to the Ford Service Center right where the wreck happened and at the time of the wreck happened. he told me he saw the whole thing and then he told the cops that and they made him file a statement. would i have to tell insurance or would he have to tell them that he saw it???

oh ya, guess i will be driving the ranger for a while now, oh darn... Lol! if they give us enough money for my truck then my dad and i might just end up taking the money and running and scrapping the truck, plus my other blazer, and he will get the money and go buy him a new truck.

btw! she was driving the rental vehicle because she had just gotten into a wreck a few days previous to when i hit her! wouldnt you think if you get into 2 wrecks with in a few days you need to stop driving???

You can tell them, and give them his info if they ask for it. Usually they ask if there are witnesses.

lol. i looked up her records and she has an arm length of shit, and her boyfriend has a ton more than her. all of their stuff is completely public. she has drug charges on her, weapons charges, child support shit, speeding tickets, criminal damage to private property. its a whole bunch of shit. her boyfriends is even worse. lol

Sue the SH!T out of her.

If you did nothing wrong, she's 100% at fault (and in a crap ton of trouble).

You should be able to sue for attorney's fees, medical bills, etc.

She probably doesn't have any assets the courts can go after, but they might garnish her wages if she ever gets out of jail & works at McDonalds. Sometimes getting a legit job will be part of their probation, so you might get lucky & get a few bucks.

Keep good records of everything you can & you should have a fairly open & shut case.

You might even have a case against the rental place for letting her rent/drive a car with a revoked license.

Was there a reward for tips leading to an arrest? Since they were "so actively" looking for them. If there was, you might not need to file a claim and damage your permanent record at the insurance board.
