It will take time to sort out, but I'd be interested to hear how she could rent the car in the first place. I always have my driver's license photocopied, so Enterprise may have done "her a favor, and them a disservice", and I would think that they knowingly broke some laws. Thankfully, your injury's are minor. Things really go slow if injuries are involved. Good luck.
enterprise didnt "do her a favor". the lady i hit had her sister rent a car for her, she had a license and insurance. then her sister gave the car to her (the lady i hit) and she was driving it unauthorized.

As for going after Enterprise, they have a signed contract with the individual who actually rented the car. Get a copy of the rental agreement and go after the person who actually rented the car and gave it to the woman who pulled out in front of you.

To the OP, the lady you hit probably doesn't have a pot to piss in, and if she does, she wont willingly pay a judgment against her, so you will have to obtain a garnishment, (if she actually has a job), to get her to pay.
i only have liabilty. thats what im afraid of. and when she got out of the car, she was wearing scrubs so i assume she is like a CNA or something like that.

Don't go after enterprise. All they did was rent the car. They have no control over what happens to it while it is being rented. The person who signed the rental agreement is the person who should be sued, not the rental company.

Here is a hypothetical:

Would enterprise be in trouble if the vehicle they rented was used in a robbery? Would they have to pay back the store/bank that was robbed? No they would not.

They are not responsible for any damage or injury to you.

I know I sound cold are heartless, but you need to think before you act.

There has been some good advice given you, but the best advice is to talk to your insurance agent. They will be able to help you the best.

Heres the problem, only having liability, insurance will give you NOTHING. From my accident I learned liability is only if your at fault in an accident to pay the repairs on the other persons vehicle. Weather your at fault or not, insurance will give you absolutely nothing unfortunately.

For the TRUCK. Liability only has nothing to do with medical bills, which is a seperate part of his insurance.

This person, (the lady's sister), is the person you need to be conversing with or having your attorney talk to, if you have one yet. She is the one who is legally responsible for the rented vehicle as she signed the contract and has insurance on her existing vehicle that should cover any rental vehicle that she rents.

Now, I am not an attorney and I'm not trying to play one here, but I have rented a few cars over the years and I know what my insurance company will and will not cover in terms of rented vehicles or trailers.

Edit:

FireRanger, I understand what you are saying with the medical payments portion of his insurance. But he can also use his own medical insurance and not have to carry medical coverage on his car insurance. And he hasn't said on here as to whether or not he even has medical payments on his own policy.

welp! went to get estimates done today and called the enterprise insurance company. enterprise said that they arent liable for the wreck because it wasnt one of their own employees driving the vehicle at the time (oh well). then they told us that it is going to have to be in the hands of the insurance company of the person that rented the car in the first place. they told us "but it says here that they didnt have insurance so its pointless to do anything" then right as they said that we said "oh? you guys rented a vehicle to a person with out insurance? ok, well we will see you guys in court for that" and right as she heard us say that, she said "oh, sorry, i read it wrong. ya, they have insurance. the company is American Family" (uh huh... sure you read it wrong) lol.

well the estimates went really good and somewhat bad. lol. when we took it in to get an estimate, the body shop guys said that it was totaled but they wouldnt right it down because the amount to fix it will exceed the value of the truck. so when they totaled it up it came very close to 3,000$!!!! and that was with out the ball joints, tie rod ends, rotor (bent), beauty ring (about 40 bucks) and fixing the frame (had a dent in it about 3 inches across from the bumper bracket being pushed in). so all that would of been about another 1500-2000 bucks. we are going to try and fight to get the money to fix it and not tell insurance that its been totaled. because the only people that know its been totaled is me, my dad, and the body shop (which a good friend of ours owns) so we arent sure if we got a chance to get the 3k or get 1500k out of it. to me i think we will get the 1500k. not sure tho

if it is absolutly the other persons fault THEIR insurance will give you the money for your truck as long as they had insurance even if they have liability it still covers ther other persons vehicle just like your insurance pays for whoever you may get in an acident with

and if its totaled you get what the truck is worth cash wise i got enough for my truck to fix it and put some mods on it when mine was totaled i endedup getting about twice what i payed for the truck in the first place

That's the whole problem. The other driver was unlicensed, uninsured, and a crackhead. It is likely his only course of financial resitution for the TRUCK is suing the crackhead's friend that rented the car for her. His own insurance should be covering his medical bills up to a certain point, where hopefully his medical insurance will kick in.

This is what I was trying to tell you. Enterprise should have the insurance information you need to contact the sisters insurance agent and start the claims process. Now you can lie to the adjuster and tell him the only damage done was to the suspension of the truck, that is up to you.

Make sure you inform the agent that you did go to the dr. and your vehicle medical insurance or your own personal insurance will not be paying those bills.

This applies if the sister actually has insurance as you stated in your quote.

Yes the other driver was unlicensed and uninsured, but that makes
no difference here. The sister who rented the car for the unlicensed driver is on the hook for all of this as she signed the rental agreement with enterprise and then made the stupid decision to loan it to her worthless sister.

A lot of good advice here, but contact a personal injury attorney for advice too. They will evaluate your case and if they feel it has merit they will take it on as a percentage of the settlement at the end with no up front fees. If they want retainer fees, walk away. You don't have to wait on the insurance company and the attorney's investigator will find out who all is responsible i.e., enterprise, the driver's sister, etc. JMHO
