Moral Dilemma - Need help
We had a salesman come to the house to look into replacing the windows on our house. The cost came out to be around $7,000 to go with high quality Anderson windows using Renewal by Anderson's contractors. The price includes tearing out a small window cutting open a hole in the wall and replacing it with two larger windows. After a visit from an Anderson technician we found that somehow the salesman who came to our house missed the fact that a new, larger header is going to have to be installed in the wall for the two new windows. He called up yesterday and told us that it is going to cost us $1,000 extra in order to put in the required header for the new windows.
Here's where the moral dilemma comes in. We were required to install 5 windows in order to get 1 year interest free financing, as well as discounts of $75 per window - so we did, we're getting 6 new windows. The main reason we were doing this was to replace that little window with the two larger ones. The salesman knew this and told me because he knows our main concern was to install the two windows, he will pay out of his own pocket whatever portion of the $1,000 we asked him to. In other words, we pay what we feel is right, and he'll front the rest... himself. So the question is, what do we do... do we have him pay 100% for his mistake out of pocket, or do we split the difference with him? While I respect his taking responsibility for this, we are putting an assload of money to this already and the extra $1,000 will really hurt us.
We have already signed a contract and have already sent out the first payment from our financing company to the contractor; they also have our down payment of $3,000. We have been told that we can drop the contract because of this situation, but we would need to act fast and I don't really want to do that.
So, tell me what you would do in the situation. Would you split a percentage with the salesman, would you have him pay the full $1000 out of his own pocket, or would you just drop the deal completely?

i would continue on with the install and have the salesman pay 50% of the mistake. a $500 mistake is easier to swallow than a $1000 one. im just not sure if i would feel right asking him to pay it all out of pocket, but thats just me.

I would say 50/50...but it makes you wonder how much commission he stands to make for the sale. That he would pay $1000 for his mistake.

I'm not too sure he meant what he said to be honest. But giving him the benefit of the doubt, i'd say go 50/50, but also just know, if he does pay for his mistake, it's not likely coming out of HIS pocket. IDK anyone, sales burp or not, that will pay out of their own pocket/take less commission for anythng.

50/50 is fair. I had the windows replaced in our house a few years ago and love it. They made a world of difference in everything.

Id say he is pulling your leg on the extra cost, this is a common practice for sales in that industry to do. make em do the job and they wont complain

eh i dunno what to say. i'd say just go 50-50 because its fair but the other side says make him pay for it all because hes probably still gonna make a profit off the job even after loosing 1,000 and if your already pushing the cost of the project then 500 more is just gonna make it that much worse.. i dunno man its a hard decision.

ex: It looks like I messed up and it will be an extra 1,000 but I will pay it if you want. So you feel obligated to pay some and you pay half or something and it goes in his pocket.
but I would do 50/50

$7,000.00 for 6 windows with some framing work is plenty.
If the new window will be wider than the old window size there is no way he overlooked the need for a larger header. Just no way.
The saleman's job is to tell you how much something will cost you so that you can decide if you'll want it. A $1000.00 oversight?
How the hell would Anderson feel about this guy approaching you like this? Does he even officially represent Anderson?
Red Flag.
Is this guy going to give you a receipt for any additional money you give him? Do you have a copy of an original and revised estimate?
Assuming that as a window salesman he did completely overlook the fact that a larger hole in a wall requires a larger $1,000 header he ain't paying a damn thing for his mistake. If anything he's just not gonna profit as much for not doing his job correctly. And informing YOU of the full involvment and cost of the work. I'm sure he'll be more careful next time.
But it was even more unprofessional of him to appeal to your sympathy by telling you "it's okay I'll pay it outta my pocket." If he got his numbers wrong, it's not your responsibility. Don't feel bad for paying the amount you agreed to pay. It's NOT a morel dilemma at all.

I think the original est. is way to high,get another quote from someone. 6 windows 150.00 per install = 900.00 how much are the windows?? I had 5 windows and a patio door replaced and was charged 100.00 per for install 4 years ago. jmo

08xlt, the price is high - I know, but I've done my research and I am getting really good windows. We live literally 15' off of a busy road and we don't have AC, so I'm getting teh best windows I can get for sound/heat insulation.
Thanks for the replies, it seems to be an even split with anybody I talk to, either it's 50/50 or none. I was thinking of giving him $200, but I think you guys are right... there's no way he should have overlooked the header.
I think I'm going to say, we're going to take the full $1,000 and if your guys do a good job, we'll call you back to replace our bay window later on. This gives him an incentive not to screw us, and maybe we'll call him back for the next job.

I personally Winks wouldn't pay any part of it. The contractor should have know when he was doing the estimate that the larger header was required to meet building codes.

The price might dictate job conditions that would make the cost higher and also local rates vary widely from one place to another in the country, but there is no way that the customer who has a signed contract should pay a penny of the mistake if there is one. that is up to the store and contractor to cover.
THAT IS WHY YOU SIGNED A CONTRACT!!!!!!!!!! TO PROTECT YOU FROM THIS HAPPENING
I'm a retired contractor and no way would I ever do this to a customer

Well Brian, if you're a retired contractor, hopefully you worked in a time where things were better. The few people we've dealt with so far with this house have been *******es.
I told him we'll take him up on his offer for the $1,000 and keep the contract. He's coming over tomorrow morning with a "supplemental" to sign. I'm guessing it's another way of saying change order... I just have to make sure to figure out how he's going to go about the $1000. I am going to ask him for something in writing there on the spot.
