YA after they got my side of the story looked at the truck and saw no damage, other than what could be a toss up between bug splatter or her nastiness.

They started to see the scam at work. Especially when I told them her husband just happened to show up like 45 seconds after the whole thing took place and he knew all about it.

I am still baffled about the 1st guy being with the lady then booking after it happened and the husband showing up. Because he pretty much told the same story I did. So if he was suppose to be in on it he blew it for them.

She actually only jumped 5-6 ft in to the ditch they were 13.5 away from the cross walk

good think your truck came out on top awith barely any damage theres some intersections here where i live that are similar to the one your describing, ive almost been t-boned twice, seen dozens of other drivers almost aswell over the years

Not at all, that is a misconception that is repeated constantly in the name of safety. It's a great rule of thumb, but it's not completely factual. For example, when you have some idiot try to run across a freeway and gets hit, the pedestrian is at fault, and if they survive they are often cited. It basically boils down to requiring both parties to act reasonably.

Just for kicks, here is the legal mumbo jumbo for California regarding this:

No pedestrian may suddenly leave a curb or other place of safety and walk or run into the path of a vehicle that is so close as to constitute an immediate hazard. No pedestrian may unnecessarily stop or delay traffic while in a marked or unmarked crosswalk.

(c) The driver of a vehicle approaching a pedestrian within any marked or unmarked crosswalk shall exercise all due care and shall reduce the speed of the vehicle or take any other action relating to the operation of the vehicle as necessary to safeguard the safety of the pedestrian.

(d) Subdivision (b) does not relieve a driver of a vehicle from the duty of exercising due care for the safety of any pedestrian within any marked crosswalk or within any unmarked crosswalk at an intersection.
