Off road lights do not have to be wired so that they can not be on when the high beams are on like fog lights do?

Just asking because on two previous vehicles I have had I installed fog lights myself by wiring them in the same way you wired those in. And neither of my vehicles would pass state inspection because the fog lights I installed were not wired in through relays that would not allow them to be on if the high beams were on. So they had to be totally removed or wired in correctly in order to pass.
