To Bama Boy. It sounds like you have a summons, not a ticket. You have to go to court. Period. You can't just pay it like a normal speeding ticket. Your moronic excessive speed probably exceeds the limit of a speeding ticket and off to court you go. Do not be surprised if you have to walk home. What you did was beyond stupid and there is no legitimate defense or excuse you can present to the court.

That may be the case in Minnasota where you live. But your state laws do not apply to Alabama. Punishments are different on a state-by-state basis and its unlikely Alabama has such a law.

No you can't. You can refuse to SIGN the ticket which is basically meaningless. You still have to either pay it or take it to court and fight it. You can NOT refuse to accept the ticket from the officer.

I sense change coming based on your poor understanding of the law.

I know you feel terrible. I'm sure your friend does too. But in this case, neither you nor your friend are responsible for her death. 30 in a 25 is nothing and had the car been going 25mph instead, the outcome would have been no different. Hell, if the car was going 20mph, it would probably still have been fatal. Assuming the driver was paying attention and the kid just ran in front of your car, the kid and her parents are responsible for her death, not you and not your friend. Do not make yourself guilty. When you have to go to court, you tell them the facts and you have nothing to apologize for. You weren't driving and you weren't speeding.

Tickets vary everywhere. I got one doing 65 in a 35 with a suspended license. I should have gone to jail. But I didn't because I was polite and had a friend with me. I shouldn't have been doing it but that ticket cost me 324 bucks. Montana a ticket for that speed may cost me 240. A seat belt ticket here is 24 dollars. In Washington that's 124 for your first offense, adn whoever else is in your vehicle not wearing one is another 124. And It's usually not a good thing if there is no amount on your ticket, it means you are usually going to court and life is going to suck big time.

I should add that I haven't had a ticket in two years, and generally don't speed anywhere anymore. Worst I get is passing on a two lane highway. But it's a lot different passing on a two lane here then back home in Washington.

I thought it was only $101.... and the ticket goes to the person not wearing the seatbelt (if over 16) not the driver, so buckle up in WA people!!!

It's $124, $101 is the smallest speeding ticket. And anyone in the car not wearing a seatbelt gets the driver a ticket, only if you are under 16 do you not get the ticket. The passenger gets one to if 16 or above but again so does the driver. That is what my understanding is through my Dad that worked for Washington state DOT.

That would be wrong....

Can I be issued a (Notice of Infraction) ticket for no seat belt if a person in my car is over 16?
No. The driver of a vehicle is only responsible for ensuring all persons 15 and under are properly secured in a seat belt or other safety restraint device as required by law. All persons age 16 and over may be issued a separate Notice of Infraction.

they do it here all the time and its not against the law sadly, but i was speeding so i took the ticket, i knew what i was doing before hand. i was probably doing even more but he wrote it for 69 instead of 70(which would have been more money over 25mph!) because i was calm and did not bitch at him. and if i refused the ticket i am sure he could have found many thing on the old truck to write up(no cat, loud exahust, dark tail lights...) refusing a ticket or anything from a cop is like running from a ass woopin', just makes it worse once they get you.

Alrite, I can live with that lol. And I said my understanding of it. Not that I was 100% positive lol. Tickets a ticket it still sucks.

And as for refusing a ticket after that they can probably come up with tons of reasons to search your truck and write you more tickets for things that are not withing the law. I also don't want them searching my truck because I carry firearms with me that are not in my name because they are both older than the laws for registration. And there are probably about 50 beer cans in the bed so they would look for booze etc. Not fun, I've had them do it. I was squeaky clean that night and they just gave my buddy a ticket for his little stunt that got me pulled over.

He was mooning some girls, while I slammed on the brakes and pulled over because I saw the cop. Hence I did not get a ticket as I was beating the crap out of him when the cop pulled up. And trying not to laugh.

They can search your vehicle when you refuse to sign a ticket (search incident to arrest) because at that point you are saying you want to be arrested. In most states signing a ticket is in lieu of physical arrest (or your promise to appear), kinda like posting bail on you're signature. So you're best course of action is sign the ticket and fight it in court.
