PLEASE Help. Title Issue.

Ok here is the deal. I bought a mud truck from a guy for $850. This truck has been used strickly as an off road truck for 2 years and was never plated. He told me on the phone that the title was never signed. I said no big deal, although not legal I was planning on just signing my name in the buyers info box after I had the local PD run the vin to make sure it wasn't stolen. I get the truck and get home and notice the title HAS been filled out in the buyers section but never transferred so there is no place for me to fill in my info. I bought the truck for something to drive on the road during winter but now I don't know how to get it titled. The guy told me and my friend that he was 18 when we picked up the truck from him. I had him sign a bill of sale stating that he was the legal owner of the truck and that he was authorized to sell it (among other things). He has been trying to work with me for the last week and a half to get a title, until today he calls me and tells me that he is only 17 and he cannot legally sign any document. So the bill of sale is void. Is there anything I can do to either get a replacement title on my own or take him to court. I really like the truck and don't wanna give it up. But I also need to have plates on it.

I would take it straight to the bmv tomorrow and show them the bos and tell them u want the title in your name and see what they say. I honestly don't have and experience with this issue, just my approach I would take

I'll go there and ask what my options are. I have already taken the BOS and Title there and they told me that I needed to somehow get the original owner to apply for a duplicate title and then give it to me. But of course they wouldn't run his name to get me a good address. My fire chief is a police officer and can run his name when he gets back (from vacation) so I am hoping that will yield a good address and let me contact him.

Try talking to the kids parents, tell them you CAN sue them for a transaction made by a juvenile who lied about his age. Tell them they are his guardians so when the suit comes down they will be named in it if they dont correct this problem in a timely manner. Make sure you tell them that because of everything you are going through, you are recording mileage (from running all this crap around) and recording your time as well. Tell them you are giving them the option to rectify this problem without going that far. You do have a good case because technically that kid never owned in because the title was never transferred, so if he made the sale, he and his parents are obligated to make it a legal sale, other than that it is a fraudulant sale

Had the same problem with the truck I just bought. You have two choices.

1. Get a title application and have it signed by the same person whose signature is on the transfer portion of the title. Taxes will have to be paid twice as it will be two seperate transactions. Almost every state requires a title transfer application in the county you live in.

2. Find the person who the truck is titled in and get a duplicate. Keep in mind privacy laws prohibit your friend from doing a search without just cause. If this person is a prick and suspects you run his info without his permission it could get sticky.

The state considers the titled owner as the legal owner. Not you and not the person you bought it from.

I just bought my Ranger and had this same problem. Basically the lady I bought it from had recently made a verbal agreement to sell the truck to her neighbor, then he backed out. She had already written his name in the purchaser block of the title, then tried to scratch it out. This is illegal to do on the title apparently. I called the county tax collector and they said I needed an affidavit stating that so-and-so was put into the purchaser block by accident and they never took ownership of the vehicle. The affidavit was on the tax collector website so I could just print it out. I filled it out and had both people sign it. I would say contact your local tax collectors office and tell them the situation and see if they have a similar process. Getting the signatures might be a pain but it beats paying taxes on two transactions or waiting on a duplicate title. Or lawyer fees for that matter. Hope this helps good luck!

OK, so... I went to the Sheriffs office this morning and told them what was going on with the truck and title. They ran the VIN and assured me that the truck was never reported stolen, so thats a good thing lol. I then went to the BMV and spoke to a different lady and she told me that I could file for a court order title. She gave me a paper that I had to take back to the Sheriffs office only for them to tell me to call this number and set up an appointment so someone could come out to my house and do another VIN check and verify the vehicle is what I say it is. THEN I take that paper they are going to fill out to the court house and set up a court date to plead my case to a judge that SHOULD (if everything goes right) grant a title in my name. SO with all that said F*&K YOU B**** R****** I hope your truck breaks down everyday you drive it and I hope I pass you in Papa Smurf so I can laugh at your ass...
