Default steel light tab vs. honda accord rear bumper

it was at about 11:30 pm and i just got done with an insulation job with my bro for jh construction in fresno, ca and i am so tired. so i get in my ranger start up and get on the freeway. since i moved out of fresno, i dont really know my way around so i follow my bro's direction to get to where i needed to get to and end up going in the wrong direction. so i get off at the nearest exit and hope that theres an on ramp going south , which is the way i need to go.

so get of the freeway and i assume that there isnt an on ramp to go south where i got off at so i go left instead. i pull up to a light and come to a complete stop, take the truck out of gear and wait for the light to change. i am 2-3 feet from the rear bumper of an accord, i fall asleep for literally 3 seconds and wake up to a crashing sound and a jolt. i let my foot off the brake and drifted slowly into the bumper of the accord and my light tab put a good sized U shape crack on top of the bumper. so i give him my info and he said he would look around for a good deal to get it fixed.

so today he calls me and he says he found a place that would replace, install and paint the bumper for $460 and i said i'd do it. so i go down there to the body shop, pay for it and was happy that i took care of it until the guy i rear ended told me that there is a small dent in the trunk and it the dent happened to magically be in front of where i cracked his bumper. so he wants me to fix it and i see no sign of paint from my light tab being where the dent was and he also wants me to pay for a rental car for him to drive for 2 days. long story short, this guy is trying to hustle me out of my money and im afraid that he will file a claim to the insurance company and make my insurance go up. what do you guys think i should do?

Well is it worth it to you to try and fight, spending more time and money, for a possible victory? Or is it cheaper in the long run to just pay to make him happy (assuming it's not a ridiculous amount), and not have higher payments on insurance?

Hope you paid him check vs. cash for the transaction and used the memo line for accident or something relevant. Also, I suggest calling his bluff and say that you will get the insurance regulating commision at the state level involved because of possible fraud. If all else fails, tell him to call the police -- maybe he'll have a record and/or no insurance and refuse. You can usually tell by the reaction you get, and go with your gut instinct. W/O knowing your driving history, you may want to get your insurance co. involved, but your rates may rise unless you have 1st accident forgiveness. A small fender bender like that shouldn't raise your rates that much -- unless you have a history of claims, are young, or otherwise have special circumstances.

well we discussed what i was going to pay for the night i rear end his car and i told him that i was going to pay for your bumper and thats it. plus he discovered that dent when he was waiting for me at the body shop, he didnt even know that it was there the night before. i think he is just trying to make me the fix dent and scratches on his bumper that he caused

no there is no way i caused the dent in his trunk because when the light tab hit it caused the bumper to crack and ,made a U shaped crack and it scratch the paint on the bumper and the scratch stopped more than a 1/2 inch away from his trunk. and fifthranger i paid in person with my debit card so there is no way he could keep coming back to me for money

well this is my first rear ender and i have not been in an accident before so yeah. i cant cancel the order on the bumper because it is already at the shop ready to be painted
