Default A sad tale...?

Let me start a few years back. About 12 years ago I bought my first Ranger, a 89 no frills truck. (well it did have a radio) I turned the odo over twice and didn't do much other than one clutch and one set of brakes. Oh yeah, a $9.00 timing belt too.
Anyway, a couple weeks ago I flung a rock through the drivers side window while weed-wacking at grannies. (Yiayia's to some of us)
That and a few other things led me to look for another Ranger.Saturday the 7th I found one at B&B auto sales in Puyallup Washington. Good looking (high milage) 2002 Ranger XLT with everything the old one didn't have. AC, PW,PS,PB, cupholders....everything. So, I paid $6000, traded in my old tired Ranger and went home.
This is where it gets interesting, or sad.
The next day,Sunday, my GF and I head to Seattle for a concert and the new to me Ranger tosses it's transmission in the middle of a very busy intersection. No forward, no reverse. (at this point I only clocked 22 miles) I waited an hour and a half for a the tow truck to show up. In the meantime my GF walks home to get her Honda (we still want to see the concert) I have her call B&B to let them know what happened, and they tell me to have it towed back to their lot.
Monday they tell me that they'll replace the transmission but will not reimburse me for the tow. Friday, almost a week later, they call me and let me know the Ranger has another tranny installed, so I leave work early and pick it up. I drive about a mile when the OD OFF light starts flashing. I take it back and they tell me to take it home for the weekend and see if the light goes out. They tell me about the engine not talking with the tranny through the computer and sh#t like that.
So, I log on to this forum and learn a ton on the OD OFF and the codes that can be read from the CPU. I decide to take it back this morning and have them read the code and tell me what it is. I wrote it down, something about the torque converter clutch that was bad. They said they would get me another transmission and they'd call me when it comes in. So I go back to the Ranger to get to work, as I'm now three hours late, and it won't go into any gears, forward or reverse.
I only clocked a total of maybe 55 miles and only had in in my hands for 65 hours
Now I'm thinking it will be another week that I'm out of a truck and who knows how many miles this next tranny will last. They didn't offer me a loaner car or anything else (remember they wouldn't even pay for the towing)
At this point I want my money back, but I'm afraid this will involve a lawyer and more time off from work.
Thanks for letting me rant. If you live in the PNW be aware of this car lot.

Jim

PS Any lawyers out there?

Should of asked them to do a manual tranny swap. haha Bad luck with those autos bro. At least they are keeping their word on replacing the tranny. Alot of companies wouldnt do that down where i live.

Keep your receipts, and paperwork go to small claims court. Tell the dealer if they dont make it right you will pickett outside their shop with all your receipts

----------

Hope everything works out with ur truck man so u can enjoy it.

I don't see what the real problem is... they are replacing the transmission and working on your truck for free, yet you want to sue them because they won't give you a loaner or pay for the tow costs?
Be thankful they are paying for the transmission work and the actual transmission.

Well, other than not having a truck to get to work in, taking off from work to get this sorted out, paying on a truck that I don't have, only driving 25 miles before the tranny goes out -TWICE-
If I bought the truck for $600 and it broke down the next day, I would be a bit more forgiving. For $6000 I presume that I'm buying a vehicle that will last more than 25 miles.

damn man im sorry, i believe with dealers there is something called the lemon law, if something keeps going wrong the car is considered a lemon and they have to refund the money or get you in something else. im not sure if this applies to used cars or not... i bought my 99 with an auto and 113 on the odo, it threw a check engine light the first day i had it, took it in and the guy said as is, i said my family has a lawyer that would gladly give him a call, and he fixed it right away. hope shit works out.

Doesn't matter if it had a warranty or not. You're expecting that truck to be functional. They are not doing him any favors by fixing it they are doing what they should do. I would be annoyed they didn't fix it right the first time.

Used cars don't qualify under the lemon law. Unfortunately, it is a gray area in your case since they are offering to fix the problem (even though they were unsuccessful the 1st time) and normally dealers will write on the bill of sale "as is". You are right that one would expect the vehicle to last more than 65 hours and 55 miles. You state the vehicle has high miles. How high? I would suggest possibly taking them to small claims court because you might be able to argue that they should have known there was an issue, and they sold it anyway. However, I don't know what the limit is for damages in your state for small claims. In Ohio, I think the value has to be under $3000. Last, you are financing, so you agreed on $6000 but didn't yet pay the full amount of money. Maybe the bank you took the loan out from can help pressure them, or did you agree to pay them direct? Don't keep us in suspense since I noticed there is a three week lapse in time from your post. Hope everything gets solved.

OK, Here's the latest.
I went to a lawyer and he said basically I was hosed as far as getting my money back.
I could take them to small claims court to try to recover up to 5000 back, and I have two years from the point of sale to file if I wish. But he also warned me that the contracts used car dealers have are pretty iron clad regarding the term "as is" and other such provisions listed in the fine print. So, with that in mind,I went to the dealer later that day and picked up the truck. Next stop was to a Ford Dealership for an inspection.
Everything looked good, and no leaks, so I had them change all the fluids (except the tranny) and drove it home. It bucks a bit going into third, but so far, the OD light hasn't started flashing. After I had it back from the used car lot another day or two, the check gas cap light came on. the car lot mech said I should buy a new gas cap, so I did, and now the check engine light comes on instead. At that point I decided to purchase a OBD2 code reader. So it seems that there is a problem somewhere in the EVAP system.
-sigh- It seems like one small problem after another.
If I can get this all sorted out, I'll most likely keep it. If I have to spend all my weekends fixing it instead of driving it, I'll sell it and take a loss.
-Back at the start of this, I asked for a refund, but was told to take it home and 'get used to the feel if the new truck' only to find out that was a ploy to make sure I had it for 48 hours to satisfy a return clause in the contract. Over the phone they told me I could trade it in dollar for dollar on a different truck, but when I tried to do that with a newer Ranger they said they would only give me 3500 credit on the Ranger I paid 6000 for a week earlier.
So, bottom line- I was an idiot on the lot and made many mistakes. Hopefully I'll remember some of them next time if I buy a car off a lot.
Jim
BTW- The Ranger didn't come with a jack or any of the other parts in that kit. So I'm still looking....02 XLT... anyone?

a check gas cap light...? you have a cluster from an exploder I think. I dont know if the rangers had that light. sounds fishey. at least your getting your tranny fixed. Here in michigan there is a 3 day lemon law. perhaps you have something similar....?
